Adventure Guidelines
These Terms and Conditions explain the rights and responsibilities that apply when reserving or participating in an Amazon Xtreme Fishing trip. They contain important payment, cancellation, insurance, health, safety, and liability provisions. Please review them carefully before submitting a deposit or other payment.
These Terms and Conditions, the Trip Confirmation Notice, official itinerary, reservation form, and any written addenda issued by Amazon Xtreme Fishing, LLC ("AXF") form the agreement between AXF, the purchaser, and each participating guest. The agreement becomes binding when AXF receives a deposit or other payment.
The person submitting payment confirms that they have reviewed these terms and, when booking for others, are authorized to provide their information and communicate these terms to every participant included in the reservation.
"Guest" means every person named on or participating under a reservation, whether or not that person submitted payment directly. "Trip" means the package of services identified in the Trip Confirmation Notice and official itinerary. "Trip Price" means the amount charged by AXF for the included services expressly identified in those documents.
If promotional materials conflict with the Trip Confirmation Notice or official itinerary, the Trip Confirmation Notice and official itinerary control. A later written addendum issued by AXF controls over an earlier document to the extent of a direct conflict.
A non-refundable deposit equal to 50% of the Trip Price per person is required to request and secure a reservation. A reservation is not confirmed until AXF receives the required deposit and completed reservation form and issues a Trip Confirmation Notice. Final payment is due 90 days before the scheduled departure date. Reservations made within 90 days of departure require payment in full at booking.
Failure to make a payment when due may be treated as a guest cancellation, and AXF may release the reserved space without waiving any amount then owed under these terms. Payments may be made by check, money order, bank wire transfer, or another method accepted by AXF. Credit card payments incur a 4% transaction fee.
Travel to the remote Amazon requires substantial advance planning, reservations, and non-recoverable commitments by AXF. AXF therefore cannot provide refunds for guest cancellations except as expressly stated in these terms. AXF strongly recommends comprehensive travel insurance covering the full Trip Price, cancellation, interruption, travel delay, illness, family emergencies, accidents, baggage, medical treatment, and emergency evacuation.
Guests should also consider coverage for pre-existing conditions when available. Some benefits and waivers are time sensitive, so guests should purchase coverage within 20 days after paying the deposit to maximize available options. Each guest is solely responsible for selecting a policy and reviewing its coverage, exclusions, limits, and claim requirements. AXF does not issue insurance, guarantee coverage, or decide whether an insurer will pay a claim.
The Trip Price includes only the services expressly identified in the Trip Confirmation Notice or official price list. Airfare, personal expenses, insurance, gratuities, and other items are excluded unless expressly listed as included.
Prices are based on known fuel costs, taxes, exchange rates, supplier charges, and operating expenses at the time quoted. AXF may correct clerical or pricing errors before final payment and may pass through material increases in government taxes, fuel costs, transportation charges, or supplier-imposed costs outside AXF's reasonable control. AXF will provide written notice of any material surcharge.
All guest cancellations must be submitted to AXF in writing and are effective when received. Deposits, final payments, discounted rates, and promotional rates are non-refundable. A canceling guest may propose a replacement participant, subject to AXF's written approval, completion of all required forms, payment of any price difference or supplier fee, and compliance with applicable travel requirements.
AXF may fill an open space but is not obligated to do so, and AXF's placement of another traveler does not create a right to a refund. If a cancellation changes group size or room, boat, charter, or occupancy arrangements, AXF may adjust assignments and place another eligible guest with the group. Credits or transfers are valid only when approved by AXF in writing and may be subject to expiration dates, price differences, and supplier restrictions.
Amazon travel may be affected by weather, water levels, navigability, transportation, supplier availability, government action, public health events, labor disruptions, civil unrest, natural disasters, and other conditions outside AXF's control. AXF may modify the itinerary, route, fishing area, guide assignment, transportation, accommodations, sequence of services, or departure date when reasonably necessary for safety, operations, or trip quality.
Comparable substitutions will be used when reasonably available, but exact equivalence is not guaranteed. If AXF reschedules or cannot provide a material portion of the Trip due to circumstances beyond its reasonable control, AXF may offer a future-trip credit less unrecoverable supplier costs. Cash refunds are not guaranteed. AXF is not responsible for incidental costs such as airfare changes, hotels, visas, lost wages, or personal expenses.
No refund, credit, or price reduction is provided for a guest's late arrival, early departure, voluntary absence, missed activity, unused accommodation, unused meal, decision not to fish, removal for misconduct, failure to obtain required travel documents, or inability to participate for personal, medical, or transportation reasons. Additional arrangements requested by a guest are subject to availability and are paid by that guest.
International and domestic commercial airfare is not included unless expressly stated. Airlines and other transportation providers control their schedules, baggage rules, refunds, credits, and passenger obligations. AXF is not responsible for flight delays, cancellations, schedule changes, denied boarding, missed connections, lost baggage, or the resulting failure to join the Trip.
Guests should allow adequate connection time and avoid non-changeable travel arrangements when practical. Costs caused by an airline or independently booked service are the guest's responsibility and should be submitted to the relevant provider or travel insurer.
Each guest is solely responsible for obtaining and carrying a valid passport, visa or electronic visa when required, entry and exit documentation, vaccination records, permits, and any other document required by Brazil, a transit country, an airline, or another authority. Requirements may change without notice and may depend on citizenship, residency, age, routing, or prior travel.
AXF may provide general information as a courtesy, but it is not legal, immigration, or medical advice. Guests must verify current requirements directly with the appropriate governments and transportation providers. Denial of entry, detention, fines, or missed services caused by missing or defective documents are the guest's responsibility. Guests must comply with applicable laws, customs, fishing rules, and instructions from local authorities and AXF personnel.
A guest under 18 years of age must travel with a parent, legal guardian, or responsible adult approved by the parent or legal guardian and AXF. The accompanying adult is responsible for the minor's supervision, conduct, documents, medications, safety, and compliance with guide instructions.
When a minor travels without one or both parents, additional notarized consent, custody, birth certificate, translation, or apostille documents may be required. The responsible adult must verify current requirements before departure. AXF may establish destination or activity-specific minimum ages when reasonably required for safety or operations.
Remote Amazon travel may involve heat, humidity, insects, uneven surfaces, boat transfers, limited communications, and delayed access to advanced medical care. Each guest must assess whether the Trip is appropriate for their physical condition, mobility, medical history, and experience.
Guests must disclose before final payment any condition, allergy, dietary need, disability, medication requirement, or requested accommodation that may materially affect participation or emergency response. AXF will consider reasonable requests but cannot guarantee every accommodation in a remote environment. Guests must bring an adequate supply of permitted prescription medication in original packaging and obtain medical advice, recommended vaccinations, and overseas health coverage appropriate to their itinerary. AXF may require medical clearance when reasonably necessary.
Guests must follow safety briefings, guide instructions, boat and aircraft rules, catch-and-release practices, and applicable fishing regulations. Harassment, threats, violence, illegal conduct, unsafe handling of equipment, excessive intoxication, interference with guides, or conduct that endangers or materially disrupts others is prohibited.
AXF may restrict an activity or remove a guest from the Trip when AXF reasonably believes it is necessary for safety, legal compliance, or group welfare. A removed guest receives no refund and is responsible for all resulting transportation, lodging, medical, and personal costs.
Guests understand that wilderness travel, fishing, boating, small aircraft, wildlife encounters, remote lodging, and outdoor activities involve inherent and other risks, including injury, illness, infection, drowning, falls, bites, equipment failure, transportation accidents, severe weather, delayed rescue, and death. Each guest voluntarily accepts the risks reasonably associated with the Trip.
In an emergency, AXF may arrange first aid, transportation, evacuation, or other assistance that AXF considers reasonably necessary. The guest authorizes the release of relevant medical information for that purpose and is responsible for resulting costs. Nothing in these terms excludes or limits a liability that cannot lawfully be excluded or limited.
Fishing and wildlife experiences depend on natural conditions that AXF does not control. AXF does not guarantee weather, water levels, navigability, fish location, species availability, catch quantity, catch size, wildlife sightings, or any particular result. Guides use local knowledge and reasonable judgment to select locations and methods, but prior results, photographs, testimonials, and promotional materials are illustrative only. A change in natural conditions or fishing results does not entitle a guest to a refund or credit.
AXF may arrange services provided by independent airlines, charter operators, boat operators, lodging providers, ground carriers, guides, and other suppliers. Local standards and amenities may differ from those in a guest's home country. AXF may substitute accommodations or suppliers when reasonably necessary.
Independent suppliers control their operations and may impose separate terms. To the extent permitted by law, AXF is not responsible for an independent supplier's acts, omissions, insolvency, schedule changes, or failure to perform, except to the extent directly caused by AXF's own actionable conduct.
Guests are responsible for passports, cash, electronics, fishing equipment, medications, baggage, and other personal property. Baggage size and weight may be restricted on charter aircraft, boats, or remote transfers. Guests must follow the limits communicated by AXF or the carrier. Excess baggage may be refused, stored, delayed, or transported at an additional cost. AXF is not responsible for normal wear, weather exposure, loss, theft, or damage to personal property except to the extent required by applicable law.
AXF may photograph or record trip activities for operational, editorial, and promotional use. By participating, each guest grants AXF permission to use their image, voice, and likeness in lawful promotional materials without additional compensation. A guest who does not wish to appear in promotional content must notify AXF in writing before departure and should remind the trip host on arrival. AXF will make reasonable efforts to honor the request but cannot control photographs or recordings made by other guests or third parties.
A guest must promptly notify the trip host or AXF of a service, safety, or accommodation concern and allow a reasonable opportunity to address it during the Trip when practical. A post-trip claim must be submitted to AXF in writing with relevant supporting information. Failure to provide timely notice may limit AXF's ability to investigate or correct the issue. This section does not shorten any mandatory legal deadline that applies under governing law.
This agreement is governed by the laws of the State of Amazonas, Brazil, without regard to conflict-of-law principles, except where another law must apply and cannot lawfully be waived. A dispute not resolved informally must be brought in a court of competent jurisdiction in Manaus, Amazonas, Brazil, unless applicable law requires a different forum.
If a provision of this agreement is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. AXF's delay or failure to enforce a provision is not a waiver of that provision or any later breach. A guest may not assign a reservation, credit, or right under this agreement except through a replacement or transfer expressly approved by AXF in writing.
This agreement replaces prior oral or written discussions about the same reservation. No agent, guide, host, supplier, or other person may change these terms or make a binding promise on AXF's behalf unless the change is confirmed in writing by an authorized AXF representative. Electronic records, signatures, reservation forms, and payment confirmations may be used to form and evidence the agreement to the extent permitted by law.
