01. ACCEPTANCE OF THE CONTRACT:

Upon purchase of the tour package, the terms and conditions herein form a binding contract between the purchaser and Amazon Xtreme Fishing, LLC ("AXF"). This contract is deemed accepted upon AXF's receipt of the deposit. By submitting payment, the purchaser confirms review and acceptance of the trip itinerary, to be performed in Rio Negro and/or the Amazon Basin - Amazonas – Brazil.

 

02. DEFINITIONS:

A. The purchased angling tour package comprises the "Trip Itinerary" provided by AXF, detailing scheduled activities and services. In case of discrepancies, the itinerary prevails over other promotional materials.

B. Confirmation of Travel Arrangements: AXF confirms travel arrangements upon receipt of Non-Refundable Deposits and Completed Reservation Form, issuing a formal "Trip Confirmation Notice" to the purchaser.

C. Hotel/Lodge Accommodations: While efforts are made to utilize advertised accommodations, substitutions may occur. Accommodation standards adhere to local classification.

 

03. RESERVATIONS AND PAYMENT:

Reservations require a 50% non-refundable deposit, varying by trip package. Early reservations ensure preferred travel dates. Final payment is due 90 days prior to departure. AXF accepts deposit payments via Check, Money Order, or Bank Wire Transfer. Credit Card payment have an additional 4% transaction fees.

 

04. PARTICIPATION:

Purchasers are responsible for selecting trips compatible with their health and interests. AXF reserves the right to decline or remove tour members that may disrupt group dynamics, with no refund provided.

 

05. PRICE OF THE PACKAGE:

The angling tour package price includes pre-paid services outlined in the official "Price List." Prices are subject to change due to fuel cost, cost of operations, exchange rates, etc. Package rates pertain to current season trip, future trips, rates may vary.

 

06. CANCELLATION POLICY:

Trip deposits and payments are non-refundable. However, cancellations made 120 days prior may apply payments to a future trip. Travel insurance, including Trip Interruption Coverage, is strongly recommended.

 

07. REFUNDS:

Discounted rates are non-refundable. No refunds are issued for cancellations within 90 days of departure, guests can assign a replacement guest in their place. Unused services or itinerary changes are not eligible for refundss.

 

08. AIRLINE/AIRFARE CONSIDERATIONS:

AXF is not liable for missed trip, transfers due to airline delays. Purchasers are responsible for all additional expenses incurred during transfers.

 

09. IMAGES/PHOTOS/VIDEO RIGHTS:

AXF retains rights to use all trip images, videos in promotional materials upon acceptance of these terms.

 

10. CHANGES IN ITINERARY:

AXF reserves the right to alter services due to uncontrollable circumstances. Inadequate sign-up may result in trip rescheduling, with future trip credits provided.

 

11. WARRANTY DISCLAIMER:

AXF does not guarantee tour expectations, especially regarding weather, water levels or fishing conditions. Purchasers accept all associated risks.

 

12. RELEASE OF LIABILITIES:

Travelers release AXF and affiliates from any liability for injuries, illnesses, or fatalities during the trip. AXF acts as an agent in transportation matters, with liability limited to airline and accommodation contracts. In consideration for being permitted to participate in the Program, Traveler hereby releases and forever discharges AXF, its partners, guides, staff, employees, and affiliates from any and all claims, demands, actions, or causes of action arising out of or relating to any injury, illness, or death that may occur during or as a result of Traveler's participation in the Program, including but not limited to injuries, undisclosed illnesses, medical issues, or fatalities. E-Vac insurance is highly recommended.

 

13. CHOICE OF LAW AND VENUE:

Any legal matters arising from this contract shall be governed by the laws of Amazonas State, Brazil. Legal actions shall be brought in a court of competent jurisdiction in Manaus, Amazonas, Brazil.
